Protocol(Act) 16

We have bought a property just outside Bansko (2 Rivers holiday village). The property has been finished all but for a few cosmetic touches but we have been waiting for Protocol 16 for 6 months of more. Has anyone else found this problem. We are being told that there is a problem in the department dealing with this in Razlog with a backlog of properties waiting.

If you read through a lot of the posts on this forum regarding people who have bought property out there you will see that EVERYONE has the same type of concerns as you do and it is even worse for those who are desperate to get rid of their "investment" due to the over supply and zero demand for a second hand property.

My understanding of act 16 is conditions of use, it does not relate to building permission. It is when the developer on application of planning proposes usage of building and normally act 16 is a formality, it is only when there is a descrepinsy in the application that problems can arise....
Would be interested if my understanding is wrong, there are a few developments in Bansko suffering in the same way.......... Have not heard that it is due to a back up in Razlog ??

Act 16 is permission to inhabit - without it you cannot legally live in (or rent out) your apartment. You may also find it difficult to get utility hook ups. The usual practice is for the department concerned to put to the top of the list those properties where the developer bribes them.

I bought a Two Bed Apartment in Two Rivers and have paid the full amount to the Developer - 79,800 Eur plus all the legal costs a total of approx. 85,000. I took out a Mortgage to pay for it. It was supposed to be completed over a year ago and we still have not had the use of it. I have been out twice and the apartment is finished but there is no electricity connected. The Restaurant and Lesuire facilities are not completed. I had a friend who lives in Bansko check it out again approx. 5 weeks ago and it is still the same as it was when I was last out in May. I am very distressed about it. The Developer is saying that they can't get Protocol 16 due to a back-log in the Department. Also the developer said that he had to get permission from people to bring the electricity over people's lands to the Development as it it is quite remote and this has taken a long time. I would have thought that this should have been required before the development began. I don't know what to believe anymore- I think it might be helpful if a number of the Purchasers could communicate through this forum and maybe bring a Petition to this so called Department in Razlog-Has anybody any thoughts on this?

We have bought in Parkside Bansko and chased the builder over Act 16 - building completed early last year, but no sign of Act 16. They have given us permission to use the flat this coming season and we intend to move furniture in at end of November but are awaiting confirmation of whether the utilities are connected. Will keep you posted.

why swear at Mikey, can people not have an opinion. I think Mikey is Bulgarian and probably knows more than any on here what BG is like.
As for reap what you sow, you could say that all those people who bought off plan in BG without ever having been there to make what they thought would be easy money are indeed now reaping what they sow.

Hi Martina,
Sorry about the delay in the reply, have been away for the last week. I do think it would be a good idea to maybe get a group together to confront the developer and to say that even if Protocol 16 is not yet obtainable they shoul let us use the apartments as they have at some of the other developments. I like you cannot go on any longer without some income from this winter season.

No act 16 = no electricity = rather chilly.

Some places illegally rigged up power through existing developments but I don't know how practical this is.

Our place in Pamporovo has been inspected for Act 16 this week and legally they should tell us within 14 days if it has passed. We (unofficially) stayed in our appartment 4 months ago to test it out and electric, water, showers etc. were all working perfect. The developer kindly put furniture in for us to use.

Has your place actually had an inspection visit for Act 16? We have been told by our Lawyer that they have to tell us within 14 days of inspection if it is passed or not.

I have also bought in Pamporovo and haven't heard from the developer for several weeks about progress on getting Act 16. Would be grateful to hear which developer and complex you bought
