burning soles - continuation

well jus got back from Snow and Rock saw the assistant manager this time, he says my boots are the wrong fit????? took them one and half hours to fit them last March, had the moulds done specially, moulds were not right and neither were the boots?
Manager said he would look at "perhaps" some kind of gesture of good will???? I have to go back in on Tuesday when they will have a pair of boots of that will hopefully fit and they also re did the moulds for me today.

He also suggested I tried ...

what do you reckon do you reckon they should give me the total cost of the boots back and then I can put it towards it a new pair. bearing in mind I 100% only wore them for half a day in Bansko at Christmas
a little of my own fault should have tried them on last year more and got used to them, but surely if I was advised wrong I would think I should get the whole cost of the actual boots back - the moulds they did again for free today.

just any advice with what you all think would be great, forewarned is forearmed etc.....
anyone else had a similar experiance with Snow and Rock

reckon the guy who sold them me is in for a nasty time when I do take the receipt in, manager was not very happy!!!!

Less than 12 months you have a good case for your money back. Be it a washing machine or a TV it has to do the job that it is designed to do and badly fitted boots don't do that.

I am now thinking of taking mine back in.

I was a bit annoyed when the guy confirmed they were not the right boots for me and then the moulds had not been done right, reckon I should stand my ground and get the whole amount back

You must now record all discussions with them and write to their HQ. This willprobablyget beyond the manin the shop even if he is the " manager "

you don't need to report to HQ if they sort it out in the shop.

Just tell the manager you are going to seek advice from Trading Strandards and watch how quickly he backs down.

Believe me it works. Give him one last chance to make good, then tell him to expect a call from TS.

I've just had the same experience with another shop.
They tried to give me a credit against a new pair of boots, but since the ill fitting pair were substantially reduced because they were old stock, a new pair would have cost me an extra £100.

Eventually after trying on lots of new pairs, I decided that they hadn't got any that suited my feet. They were good enough to give me a full refund, even though I didn't buy another pair.

I should try being nice to them, you're more likely ...

I should try being nice to them, you're more likely to get a favourable response than if you go in all guns blazing. You can always get stroppy later if need be.

Sale of goods act 1979.
Goods must be fit for the purpose for which they were sold.
This consists of several promises by the seller.(legally binding)
Promise 1
The goods are fit for their usual use.
Promise 2
The goods are of proper quality
Promise3
The goods are as described
Promise 4
His sales talk is true.
They have failed on several of these points.

They are not fit for their usual use as they did not fit you properly.
They were not as described as they were not fitted ...

They are not fit for their usual use as they did not fit you properly.

His sales talk was not true as he did not fulfill his contract as he incorrectly fitted the boots.

You shoud be due a replacement set of boots, of equivalent value/quality that are fitted correctly.
If they cannot fulfill this for any reason, then you will be able to ask for a full refund.

Be pleasant at first, but if that fails complain very loudly near any prospective boot buyers, they should soon want to shut you up!!

great advice from you all, going back tomorrow for new boots,,, so we will see I will let you know how it went...

thanks a lot guys - see you in Pamps maybe next week... can't wait, specially if my boots fit correctly
