Booked several learn to ski packages last week with Inghams, together with separate lift passes etc for the intermediates.
Just got a phone call from agent this morning to say that we couldn't book learn to ski packages for half term as Inghams had now decided to "withdraw" them, and our only alternative is to book the required items separately (and much more expensively).
Does anyone know if this is actually legal? or can these tour operators just seem to do as they please (refering ...

Not sure about the legal side Elaine, but I would see the moral side as this.......
You entered into a contractual agreement with your tour company that would almost certainly have charged you if you decided to withdraw any of your booking requirements. You paid for a service that was advertised, by Inghams, offered to you, paid for by you, and accepted by your tour operator.
They then decide to break that contract by not offering you what you agreed and paid for.

Not sure about the legal side Elaine, but I would see the moral side as this.......

Absolutely disgusting service to sell a product, then move the goalposts because it suits them.
Give them your I AM NOT HAPPY attitude and see what they are prepared to do.

Cheers Pete, problem is they haven't actually taken any money yet as holiday booking was made first, and booked ski stuff once I knew exactly who needed what.Also, no other availability now for our group at half term, and can't take kids out of school this year, so bit "stuck" (not quite the term I was after but need to keep board clean).

Still don't think the money side of it matters Elaine. They accepted your booking based on your requirements, and also accepted your booking for the ski packs. What would have happened if YOU said 'we no longer want the ski packs?' Bet they would have charged you a cancellation fee!!!!!!!I would go into the shop and DEMAND to see the manager, and ask him/her if it was common practice to break a promise.
May not be their fault, but it is their problem.

Maybe on tricky ground, as Inghams have contracts to receive the ski packs etc at a lower rate, if they book a certain amount of time in advance, and in connection with accommodation. If they didn't receive the request at the time they may be unable to get the packs discounted now.

Don't agree Peter. Sorry.If it is on offer then it should be honoured. Depending on whether 'subject to availability' was advertised. Once the FSA gets underway in January there will be no way they could get away with this sham. I presume when Elaine asked for the packs to be added she was told that it was OK. If it was not, then she should have been told at the time, not at a later time.

Write to Inghams but not to customer services go staight to the top and write to the MD. My faveourite trick when complaining.re: learn to ski packages
Just looked at the Inghams brochure on line under learn to ski - it does state available all season for Pamps except Dec 26th and Feb 12th so check your brochure.If you've booked for Pamps on Feb 12th then there are no learn to ski packs offered and they have made a genuine mistake you may not be able to argue the case.
Sorry to be the bearer of bad news on that one.

I am a trainee solicitor and I encountered a similar problem to this but on a summer holiday.
Refer to the Code of Conduct of the Association of British Travel Agents (you will find it via a google search). If they are in breach of this, you can approach ABTA and ask them to remedy the problem on your behalf.
With regards to breach of contract, you could always bring a small claims action in the County Court, but breach of contract is a tricky area of law.You would need to ...

It would also be difficult to recover anything above what you paid for the learn to ski packages, and I am guessing they refunded you the cost of them?
With regards to the sale of goods act, they are not in breach of this if they have given you a refund.
Finally!!, it would be worth knowing if they ever intended to deliver such packages, as if not then this is blatant false advetising which could be reported to the Adveritisng Standards Authority (which you can also find via a google search).
Morally, I agree that they should be doing more to help you sort out this problem.
