bulgarian dreams orchard

Hi,

Does anyone know what is going on with the Orchard development? I am supposed to be paying the final installment for this now, however when i visited Bansko in the Summer the project looked like it had a few years to go, even though I am told it will be rented out this season. I am very nervous that BD will go bankrupt and I will lose my payment. Does anyone have an honest update for me?

i would be very nervous at beleiving anything that BD tell you - especially their bent MD Robert Jenkin.

I signed for 2 apartments in Phase 3 that should have been ready now - but haven't yet been started as they have never got planning permission. I doubt very much that i will ever see the 25% deposit on both apartments ever again.

what are you going to do about it? I have seen the development and it is 70% finished, i am not sure if i should pay the final installment.

Don't pay anything without a UK bank guarantee - its easy enough to get if they are not on the cusp of bankruptcy

John i plan to get my solicitor to request the deposit back under the terms of the contract (cant do this until 6 months after the completion date which will be 1st Jan)then see how far that gets me before starting legal proceedings against the developer. I am told this may take years!!!

After sales support and customer service has been non existent from BD and in fact no one in the Sofia office will even return my emails now. The London office is no better either.

My solicitor has already looked at the contract and there is no way of forcing BD to pay a refund. It really is a terrible contract and it is the buyers fault for never getting a lawyer to look over it in the first place.

It'll be interesting to see if phase 1 gets finished.

Hi Jonh,
I have two app in orchard and they are asking for final payments!!
I am over in bansko now and they are nowhere near finished...spoken to people here and some say they will never get completed..
I am not paying anything else until full completion of development(if ever)
will be seeking legal advice

John my solicitor beleives that we can get a refund. Dont know if we have different contracts. I bought in phase 3 that hasn't even been given planning permission.

Will be trying for a refund on 1st Jan 09
